2. Subscriptions & Payments

  • Maintenance plans are billed monthly or annually in advance, depending on the subscription selected.
  • Payment is required before services are activated. Failure to pay may result in suspension of maintenance services.
  • Subscription renewals are automatic unless canceled before the renewal date.
  • We accept payments through the methods listed on our website. All payments are final and non-refundable, except where required by law.

3. Client Responsibilities

  • Clients are responsible for providing accurate and complete information required for project completion or ongoing maintenance.
  • Any delays in providing content, access credentials, or approvals may extend delivery timelines.
  • Clients must maintain backups of their data unless a backup plan is explicitly included in their subscription.

4. Intellectual Property

  • All website code, graphics, and designs created by w3facility.com remain our property until full payment is received.
  • After full payment, ownership of the final website design and code (except third-party assets, plugins, or licenses) transfers to the client.
  • We reserve the right to showcase completed projects in our portfolio unless otherwise agreed in writing.

5. Cancellations & Refunds

  • Subscriptions can be canceled at any time, but no refunds will be issued for unused periods.
  • Project-based services may be canceled, but clients will be billed for the work completed up to the date of cancellation.
  • In case of disputes, we encourage resolution through direct communication before taking legal action.

6. Limitation of Liability

  • We make every effort to ensure websites and maintenance services function smoothly and securely.
  • However, w3facility.com is not liable for losses, damages, or downtime caused by third-party providers (hosting companies, plugins, external APIs, etc.), hacking attempts, or force majeure events.
  • Our maximum liability shall not exceed the amount paid for the service in question.

7. Third-Party Tools & Software

  • Some services rely on third-party plugins, themes, hosting, or APIs.
  • Licensing fees for premium third-party tools (if required) are the client’s responsibility unless otherwise agreed.

8. Termination of Services

  • We reserve the right to terminate services immediately if a client engages in abusive behavior, illegal activities, or breaches these Terms & Conditions.
  • Upon termination, outstanding payments become immediately due.

9. Privacy

10. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of land. Any disputes shall be resolved in the courts of that jurisdiction.
